Guidelines for Third Parties Requesting Records
Overview
US Mobile, Inc. ("US Mobile", "USM", "we", "our") is committed to protecting the privacy and security of our customers. These Guidelines explain how non-law-enforcement third parties may request records and the circumstances under which US Mobile may disclose information.
General Policy
US Mobile does not disclose customer information to third parties except where required or permitted by law. We carefully review all third party requests to determine whether disclosure is legally required, properly scoped, and supported by appropriate authorization.
Who Is Considered a “Third Party”:
• Attorneys and law firms
• Civil litigants
• Private investigators
• Insurance companies
• Data brokers
• Family members, spouses, or acquaintances of a customer
Third party does not include:
• The customer to whom the records relate, or
• A government or law enforcement agency acting pursuant to lawful authority.
Required Legal Process
We generally require a valid subpoena issued in accordance with applicable law before we can process third-party requests for information. We require non-law enforcement subpoenas to be served through our registered agent for service of process.
Our registered agent, Cogency Global, can be contacted at 866-621-3524. Cogency Global will accept service only if the entity is named correctly (e.g., “US Mobile, Inc.”). Our acceptance of legal process does not waive any legal objections we may have and may raise in response.
Note: We may not respond to emergency requests received from non-law enforcement officials. Non-law enforcement officials aware of an emergency situation should immediately and directly contact local law enforcement.
Customer Requests
US Mobile does not provide records, certifications, affidavits, attestations, or other documentation at a customer’s request for use in legal proceedings, court filings, subpoenas, or other formal disputes. This includes, without limitation:
1. Requests for call detail records, usage logs, or account history intended for submission in court;
2. Requests for letters, declarations, or certifications verifying the authenticity of records; or
3. Requests made in anticipation of litigation or to support legal claims, defenses, or investigations;
4. Any disclosure of customer information for legal or evidentiary purposes will be made only in response to valid legal process (such as a subpoena, court order, or warrant) or as otherwise required by law, and must be directed to US Mobile in accordance with our Guidelines for Law Enforcement Requests or Guidelines for Third Parties Requesting Records, as applicable;
5. Communications content, except where legally compelled;
6. Real-time location tracking;
7. Prospective or ongoing surveillance;
8. Bulk account data; or
9. Information about other customers not specifically identified
US Mobile does not create new records or analyses in response to third party requests. Nothing in this Section limits your ability to access or manage information made available to you through your account in the ordinary course of using the Services, or your rights under applicable privacy or consumer protection laws.
Notice to Customers
US Mobile may notify customers before or after disclosing their information in response to a third party request. We may delay or withhold notice where required by law, court order, or legal process.
Data Retention and Availability
US Mobile does not guarantee the availability of any particular records. Data is retained for limited periods in accordance with our internal retention policies, operational needs, and applicable law. US Mobile cannot provide information that has been deleted or that we do not collect in the ordinary course of business.
