Introduction
These terms of service ("Terms of Service") apply to your use of US Mobile Inc's mobile services ("Services"). These Terms of Service apply to all of the Services we offer, including the rates, features and terms related to the call minutes, text messages and Internet data you use. The Terms of Service become effective when you accept them, which you do by making a purchase from our website. These Terms of Service are subject to change from time to time as determined by US Mobile in its sole discretion. Modified and/or updated versions of these Terms of Service will be posted at . Modified and/or updated versions of these Terms of Service will be effective immediately upon posting. Using Services after the changes become effective means you agree to the new terms. Unless expressly prohibited by law, we reserve the right to modify or cancel our service or your account or take corrective action at any time and for any reason, including, but not limited to, your violation of any provision of these Terms of Service.
Services & network coverage
Unlimited Premium Plans:
Unlimited Premium Unthrottled (Limited Time Offer):
For customers who activate their Unlimited Premium plan during the promotional period offering a version of the Premium plan with no throttling (the "Unlimited Premium Unthrottled" offer), premium data for regular usage will remain unthrottled. However, all usage remains subject to our Acceptable Use Policy, and excessive or abusive usage that negatively impacts network performance, including repeated or excessive speed tests, may result in throttling, capping, or termination of service at our discretion. Customers who activate their Unlimited Premium plan after the promotional period has ended may be throttled after using more than 100 GBs of data in one billing cycle.
• Speeds and performance: Lines on the promotional, unthrottled version of the Unlimited Premium plan ("Unlimited Premium Unthrottled") will not be throttled even if using more than 100 GBs of data in a billing cycle. However, speeds are not guaranteed and may vary based on factors outside of US Mobile's control, including but not limited to network congestion, cell tower performance, device performance. Any advertising referencing phrasing including but not limited to "never slows down", "no slowdowns", "no speed limits" strictly refers to the fact that US Mobile will not intentionally place a throttle on lines using more than 100 GBs of regular data (except for hotspot; please see hotspot policy below) as long as they are in compliance with the Acceptable and Reasonable use policies. US Mobile does not guarantee that speeds will not vary due to other factors.
• Device Restriction: This plan is available exclusively for smartphones and tablets. Use on any other device (including but not limited to modems, fixed wireless routers, or other non-mobile devices) is prohibited and will be considered abuse, resulting in immediate blocking of service.
• Promotional Period: The Unlimited Premium Unthrottled Plan is available for a limited time only. The promotional period may end at any time, without advance notice, at US Mobile's discretion, without prior notice.
• Priority Data:
Lines that activate the Unlimited Premium Unthrottled Plan offer will get priority access based on the network they choose, outlined below:
1. Dark Star: QCI8 priority access at no additional cost.
2. Warp: QCI8 priority access at no additional cost. Note that QCI8 priority is only on 5G devices.
3. Light Speed: QCI7 priority access at no additional cost.
• Continuation of service after the promotional period has ended: Lines that are on the Unlimited Premium Unthrottled Plan may continue on this version of the plan even after the promotional period has ended as long as they maintain continuous service on the Unlimited Premium plan. After the promotional period, a line that changes plans, expires, or ports to another US Mobile network may not be able to return to the Unlimited Premium Unthrottled plan. (It will be able to return to the regular version of the plan that may be slower after 100 GBs of usage). Even if lines meet these criteria, provision of the Unlimited Premium Unthrottled Plan after the end of the promotional period is not guaranteed and may be ended at any time at US Mobile's sole discretion.
• Promotional Limitation: This unthrottled service is available for a limited time only. At the end of the promotional period, new activations will be eligible only for the standard Unlimited Premium plan—and may be throttled for the remainder of their billing cycle after 100 GB of data usage.
• Existing Customer Provision: Customers already on the Unlimited Premium Unthrottled Plan at the time of promotional expiration may continue to enjoy unthrottled premium data provided they remain on the plan and network; however, US Mobile reserves the right to modify this policy and revert the plan to the standard Premium plan at any time.
• Hotspot Usage: The plan is subject to specified data usage thresholds, network dependent and outlined below:
1. Dark Star: The first 100 GBs of hotspot data are high-speed/unthrottled. After 100 GBs of usage in one 30-day cycle, speeds will be throttled to 8 Mbps for the next 100 GBs of usage. After 200 GBs of usage in one 30-day cycle, speeds will be throttled to 600 Kbps. US Mobile reserves the right to change hotspot throttling policies at any time.
2. Warp: First 50 GBs of usage in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
3. Light Speed: First 50 GBs of usage in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
• Other Restrictions: While regular data usage remains unthrottled under this offer, this plan is not meant to be used as a full-time or dedicated data connection (for example, but not limited to, as a permanent substitute for home internet or a continuous data connection). Such use is prohibited and will result in immediate blocking of service.
Unlimited Starter Plans:
• Light Speed and Warp Networks: On Unlimited Starter plans offered on the Light Speed and Warp networks, the small share of heavy data users using more than 70 GBs of data may be throttled for the remainder of their billing cycle. If a user switches to the Light Speed or Warp network mid-billing-cyle from any other network, the data usage on the prior network will carry over; the small share of heavy data users using more than 70 GB of data (combined across networks) may be throttled for the remainder of their billing cycle while on Light Speed or Warp.
• Dark Star Network – Unlimited Starter Unthrottled on Dark Star (Limited Time Offer):
For customers who activate their Unlimited Starter plan on the Dark Star network during the promotional period offering a version of the Starter plan with no throttling (the "Unlimited Starter Unthrottled on Dark Star" offer), premium data for regular usage will remain unthrottled. However, all usage remains subject to our Acceptable Use Policy, and excessive or abusive usage that negatively impacts network performance, including repeated or excessive speed tests, may result in throttling, capping, or termination of service at our discretion. Customers who activate their Unlimited Starter plan on the Dark Star network after the promotional period has ended may be throttled after using more than 70 GBs of data in one billing cycle.
• Speeds and performance: Lines on the promotional, unthrottled version of the Unlimited Starter plan on Dark Star ("Unlimited Starter Unthrottled on Dark Star") will not be throttled even if using more than 70 GBs of data in a billing cycle. However, speeds are not guaranteed and may vary based on factors outside of US Mobile's control, including but not limited to network congestion, cell tower performance, device performance. • Continuation of service after the promotional period has ended: Lines that are on the Unlimited Starter Unthrottled on Dark Star version of the plan, may continue on this version of the plan even after the promotional period has ended as long as they maintain continuous service on the Unlimited Starter plan and on Dark Star. After the promotional period, a line that changes plans, expires, or ports to another US Mobile network may not be able to return to the Unlimited Starter Unthrottled on Dark Star version of the Unlimited Starter plan. • Eligibility Restriction: US Mobile reserves the right to restrict this offer only to lines that are new to the Dark Star network. Lines that have ported out of the Dark Star network (or expired on the Dark Star network) within the 30 days from porting into Dark Star or reactivating on US Mobile may not be considered new lines. Lines that are already on the Dark Star network may not be eligible for the unthrottled Unlimited Starter Unthrottled on Dark Star offer.
• Existing Customer Provision: Customers already on the Unlimited Starter Unthrottled on Dark Star at the time of promotional expiration may continue to enjoy unthrottled premium data provided they remain on the plan and network; however, US Mobile reserves the right to modify this policy and revert the plan to the standard Unlimited Starter plan at any time.
• Hotspot Usage: The plan is subject to the following network-specific thresholds outlined below:
1. Dark Star: The first 20 GBs of hotspot data in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
2. Warp: First 10 GBs of usage in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
3. Light Speed: First 10 GBs of usage in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
• Other Restrictions: While regular data usage remains unthrottled under this offer, this plan is not meant to be used as a full-time or dedicated data connection (for example, but not limited to, as a permanent substitute for home internet or a continuous data connection). Such use is prohibited and will result in immediate blocking of service.
Unlimited Flex Plan:
On the Unlimited Flex plan, on any network, the small share of heavy data users who use more than 10 GB of data may be throttled for the remainder of their billing cycle.
• Priority Data:
Lines that activate on the Unlimited Flex plans will receive priority network access based on the network they choose, outlined below:
• Dark Star: QCI9 priority access at no additional cost.
• Warp: QCI9 priority access at no additional cost.
• Light Speed: QCI7 priority access at no additional cost.
• Hotspot Usage: The plan includes unlimited hotspot data, subject to the following network-specific thresholds outlined below:
Dark Star, Warp, Light Speed: The first 5 GBs of hotspot data in one 30-day cycle are unthrottled. Hotspot data usage above this may be capped.
Dark Star Unlimited Premium 3-month Plan + Phone Bundle:
1. Eligibility: To be eligible for this offer, the line activated on the included plan must be (a) a new line and (b) activated on the Dark Star network. Lines that expired on or were ported out of US Mobile within 30 days from activating on this plan will not be considered new lines and are not eligible.
2. Primary Network Usage: Over the 3-month promotional period, the line must remain (a) continuously active and (b) be active on the Dark Star network for at least 90% of the time.
3. Max number of bundles per account: Each account may purchase a maximum of two (2) device bundles, subject to availability while supplies last.
4. Ineligibility for referral rewards: Purchases of this bundle does not count towards referral rewards. If you have been referred by an existing US Mobile user, no referral rewards will be issued for purchasing and activating this bundle.
5. Device Compatibility: The device included in the bundle is designed to be compatible with the Dark Star network. Device performance on Light Speed and Warp networks is not guaranteed.
6. Return and Refund Policy:
a. Device return only: The phone offered with this promotion is free with the purchase of a 3-month Unlimited Premium plan. If you choose to return the device but continue using the plan, no refund will be issued.
b. Service Cancellation and Refund: If you cancel the service or request a refund for the service plan, our standard refund policy for multi-month unlimited plans (usmobile.com/terms) will apply to determine the refund amount. The device must be returned within 14 days of cancellation in its original condition, including all packaging and accessories. Failure to return the device as required will result in a deduction of $79 (the retail price of the phone) from the refund amount.
7. Device Warranty: The device included in this bundle is covered by a 45-day supplier's warranty for power or functional issues. If the device experiences any such issues within 45 days of purchase, customers may request a replacement or repair. The warranty does not cover physical damage, liquid damage, or misuse.
Multi-Network add-on
The Multi-Network add-on that is currently available on the Unlimited Premium and Unlimited Starter plans enables users to add a second and third line to the plan that share that plan's unlimited data allotment. However, it is subject to the following restrictions:
1. On all three networks (Dark Star, Warp, Light Speed), each Multi-Network add-on line will be throttled once combined data usage across primary and Multi-Network add-on line(s) is 100 GB on Unlimited Premium and 70 GB on Unlimited Starter; hotspot on each Multi-Network add-on line may be capped once combined hotspot usage across both the primary and Multi-Network add-on line(s) reaches 50GB of usage on Unlimited Premium and 10GB on Unlimited Starter. Note that the primary and Multi-Network add-on lines are not switchable.
2. The Multi-Network add-on line(s) must be on a different network than that of the primary line at all times. At time of activation, it will only be possible to activate a Multi-Network add-on line on a network other than that of the primary line and any additional Multi-Network add-on lines. After activation it will only be possible to perform a Network Transfer across lines to a network that none of the existing lines are currently active on.
3. International features (international calling, international roaming) that are included for free on the primary line are also included on the Multi-Network add-on line(s), with usage shared across the lines. For example, if a customer’s plan allots 20 GB of international roaming monthly, a user may use any combination of data on the primary and Multi-Network add-on lines—such as 20 GBs on the primary line only, 10 GBs each on a primary and a Multi-Network add-on line, etc. All international features are subject to the same roaming terms and conditions outlined in other sections of this document.
4. The primary and Multi-Network add-on lines must all be installed on the same device.
5. Multi-Network add-on lines will not include certain add-ons or features that may be included with the primary line for free. For example, while a primary line on Warp on Unlimited Premium includes the Apple Watch add-on for free, if the Multi-Network add-on line is on Warp, the Apple Watch add-on for that Multi-Network add-on line will be available, but for purchase (not free).
6. The Multi-Network add-on is only available on the latest version of the Unlimited Premium, Unlimited Starter, and Unlimited Flex plans. Users on legacy versions of these plans may need to update their plan to the latest version (go to Change Plans > Select any Unlimited plan, and it will update at the next billing cycle) to see the Multi-Network add-on option.
Other Plans:
Legacy plans no longer available for new activations may have their own usage terms that are subject to change at any time.
On Pinwheel plans, the small share of heavy data users exceeding 2 GB of data usage may be throttled for the remainder of their billing cycle. Additionally, if you use Pinwheel plans on non-Pinwheel devices, we reserve the right to issue a warning and suspend or terminate your service.
The 30 Day Free Trial offer consists of 30 GB of data and unlimited talk and text, which includes on our Warp network: Premium 5G Data, 5G mmWave and C-Band on 5G devices, and 4G LTE. On our Light Speed (previously GSM 5G) and Dark Star networks it includes high speed data and nationwide 5G. New customers only. Thirty days free is limited to one line for new customers. Certain credit cards may not be eligible for use when signing up for the free trial. You may see a temporary authorization hold on your credit card to verify the card; it is solely for verification purposes and you will not incur any charge for the free trial. Customers are not permitted to use phone numbers or devices that have previously been active on a US Mobile line. Transferring your number from some select carriers is not permitted. May not be available/combinable with other offers or promotions. While supplies last.
Additional Terms
Spam Protection: May not detect all spam and may inadvertently block wanted calls.
Web Filtering: Does not guarantee data security. May not detect all suspicious websites.
International Long Distance (ILD) calling
We provide the ability for lines on certain plans to call select international destinations, also known as International Long Distance (ILD) calling. We reserve the right to change at any time which plans support ILD. We also reserve the right to charge additional fees to enable ILD on any plan.
The list of supported international destinations may change at any time without notice. Calling to certain destinations may be blocked or capped to a limited number of minutes. Support for ILD may be terminated partially or altogether at any time without notice.
International calling is offered via a third-party vendor, NetworkIP. By agreeing to our Terms and Conditions, you are also agreeing to NetworkIP's additional terms outlined in Appendix A.
ILD Fair Usage Policy
Fair usage applies to all services provided by US Mobile, including International Long-Distance (ILD) calling. We reserve the right to limit ILD usage on lines that exceed fair usage thresholds. Fair usage will be determined based on comparison with typical usage across all ILD users.
International by-the-Gig Plan
The International by-the-Gig (“Plan”) allows eligible pool customers to share data, talk, and text while traveling outside the United States, subject to the following terms and conditions:
Eligibility:
Available to domestic customers on US Mobile shareable data pools (By-the-Gig) with up to five lines. Your US Mobile line must first be activated and used within the United States (excluding U.S. territories). Roaming features will not be provisioned until domestic usage has been detected.
Coverage:
Roaming coverage is subject to availability, network conditions, and local regulations. Service quality, including speed and connectivity, may vary and is not guaranteed. Certain features (e.g., 5G, MMS, hotspot) may be unavailable while roaming.
Adding to your line:
Upgrades may be applied immediately or at the end of the billing cycle. If you upgrade before your renewal date, your auto-renewal date for all lines will be reset to the upgrade date. No mid-cycle refunds or pro non-refundable and not prorated. Auto-renew applies unless a downgrade is scheduled.
Data:
Shared data and purchased top-ups are usable both domestically and in the applicable roaming regions of the selected variant. Destinations may vary and can change without notice. North American by-the-Gig Plan: Shared data in the United States, Canada, and Mexico. North American Top-ups: $6/GB, available in sizes between 2 GB and 20 GB. Global by-the-Gig Plan: Shared data in the United States and across supported international destinations worldwide. Global Top-ups: $6/GB, available in sizes between 2 GB and 20 GB. Add’l Data terms: Up to 3 Top-ups per billing cycle. Additional line access fee: $8 per line after the first.
Talk/Text:
Each line includes 100 roaming minutes and 100 roaming texts per cycle; additional usage requires a line-level Talk & Text top-up to be purchased through the line page.
Use:
The Plan is designed to support short-term international travel and is not intended for extended or permanent use outside the United States. Use of the Plan is subject to US Mobile’s standard International Roaming Fair Use Policy, including restrictions on excessive or permanent roaming and non-consumer uses. To ensure fair access for all customers and prevent misuse, usage patterns are monitored regularly. In cases of violation or more than 90 consecutive days of International Use with no domestic usage, we reserve the right to: Limit or restrict access to roaming services, suspend access to the Plan feature, or remove the feature from your plan entirely. If roaming usage is suspended, it may be restored once we detect sufficient domestic data usage within the United States. Customers with extenuating circumstances may contact US Mobile customer support to request a review.
General:
Subject to the U.S. Mobile Terms and Conditions. Additional restrictions may apply.
Reasonable Use of ILD Calling
Our international calling service is intended for personal use only. We consider reasonable use of this service to include regular, personal calls to individuals overseas. Excessive use, indicative of commercial or non-personal utilization, may result in restrictions on your service.
Misuses of ILD Services that Could Result in Blocking
The following practices are considered misuse of our International Long-Distance services and are strictly prohibited:
a. Reselling or commercially using our international calling feature in any form.
b. Sharing your ILD service with others to facilitate their international calls, regardless of whether you charge for this service.
c. Making calls to automated voice systems, recorded messages, or '800 equivalent' numbers internationally.
d. Utilizing ILD for business purposes, such as contacting clients, sales calls, or managing employees across borders.
e. Engaging in schemes designed to exhaust minutes for compensation or other benefits.
Violation of these terms may lead to service restrictions or termination.
Perks offer
To receive Autopay service credit of up to $15/month for one subscription perk, users must have at least three active lines on the Unlimited Premium plan in good standing with Autopay enabled.
Users must submit receipts each month to US Mobile customer support to verify they are utilizing the subscription perk for which they are receiving service credit.
Users can receive the subscription perk service credit for a maximum of 12 continuous months.
We reserve the right to alter the terms of the perks offer at any time. The perks offer may be terminated at any time without notice.
Suspension or termination
Abusive or aggressive behavior, including communication (whether verbal or written) or sharing of content that may cause our staff to feel afraid, threatened, or abused is unacceptable. This may include threats, personal verbal abuse, derogatory or lewd content, and rudeness. We also consider inflammatory, racist, and/or sexist statements, remarks of a discriminatory nature, and unsubstantiated allegations to be forms of abusive behavior. Where a customer engages in aggressive or abusive actions, we may:
1. Advise the customer that their behavior is considered offensive, unnecessary, and unhelpful and request that they cease such actions immediately.
2. Terminate any ongoing telephone calls, appointments, meetings, or chats if the behavior continues.
3. Cease all direct contact with the customer, preserving only indirect contact necessary to resolve any ongoing issues or obligations.
4. Suspend or terminate the customer's service and access to the www.usmobile.com website or any other platforms we operate, depending on the severity of the behavior.
5. Notify law enforcement authorities if there is any use or threat of physical violence.
6. Take any other actions that we deem appropriate to the circumstances to ensure the safety and well-being of our staff and the integrity of our services.
This policy is in place to protect the safety and security of our employees and customers and to maintain the quality and reliability of our services.
Reasonable Use Policy
US Mobile may also determine that abnormal, unreasonable, or impermissible usage is occurring, and may take appropriate steps even if the number of minutes/texts/data used is not excessive, when a customer's calling patterns during more than one month reflect excessive:
1. Calling of unusually high numbers of unique numbers, which may indicate improper use;
2. Extended call lengths beyond typical usage patterns, which may impact network capacity;
3. High frequency of call forwarding or transferring, suggesting potential misuse of service features;
4. Frequent use of conference calling services, which may contribute to network congestion;
5. A significant number of short duration calls, which could indicate an attempt to disrupt service or other abusive behavior;
6. An unusually high total number of calls made during a month, which may suggest automated or non-personal use;
7. Excessive calls made to conference calling services, potentially impacting service availability for other customers;
8. Predominantly making calls during business hours, indicating possible commercial use contrary to intended personal use guidelines;
9. Numerous calls terminated and re-initiated consecutively, contributing to excessive call lengths in a short time frame, which could be seen as an attempt to circumvent system constraints;
10. Other calling patterns indicative of an attempt to evade enforcement of this US Mobile terms of service.
Such behaviors may trigger a review of your account and, depending on the outcome, could lead to measures including but not limited to limitations on usage, suspension of service, or termination of the agreement. This policy is designed to prevent fraud and abuse of our services while ensuring all customers enjoy a consistent and reliable experience.
Acceptable use
This Acceptable Use Policy governs the use of US Mobile's services and devices. All users must comply with this policy, which is designed to ensure lawful, secure, and responsible use of our services. Violation of this policy may result in suspension or termination of services, as outlined below.
Prohibited Activities:
1. Illegal Activities: You may not use our services or devices for any illegal purposes, including but not limited to harassment, threats, abuse, defamation, or slander against any individual or entity.
2. Inappropriate Content: You must not send or promote content that is:
• Unlawful or fraudulent.
• Infringing on intellectual property, privacy, or other rights of third parties.
• Containing or promoting malware or harmful software.
• Involved in spamming or other forms of intrusive advertising.
3. Network Abuse: You must not engage in activities that harm US Mobile's network or other users' access to the network. Prohibited activities include:
• Excessive contributions to network congestion.
• Denial of service (DoS) or distributed denial of service (DDoS) attacks.
• Unauthorized access to or interference with networks, servers, or other infrastructure.
4. Device Misuse: Devices must be used in accordance with the manufacturer's specifications. Misuses include:
• Modifying device software or hardware beyond manufacturer settings (e.g., rooting or jailbreaking).
• Using US Mobile SIM cards in non-compatible devices.
Content Restrictions:
• Explicit Material: You may not use our services to store, transmit, or disseminate pornographic material, particularly child pornography. We cooperate fully with law enforcement regarding such violations.
• Phishing and Fraud: Engaging in identity theft, phishing, pharming, or any fraudulent activities is strictly prohibited.
Compliance and Enforcement:
• US Mobile reserves the right to monitor compliance with this Acceptable Use Policy.
• Suspected violations may lead to investigations and, if necessary, enforcement actions including service suspension or termination.
• We will notify users of alleged violations unless immediate action is required to prevent ongoing harm.
Additional Note for Unlimited Premium:
Even though regular data usage is unthrottled under the promotional "Unlimited Starter on Dark Star" and "Unlimited Premium" plans, users remain subject to the Acceptable Usage Policy. Excessive or disruptive use that negatively impacts network performance, including repeated or excessive speed tests, may result in temporary throttling, capping of speeds, or termination of service at US Mobile's discretion.
Porting numbers
If you wish to port any existing telephone numbers from another carrier to US Mobile, you must complete the authorized porting process as defined by US Mobile; you agree to follow US Mobile's then-current Policies. In addition to completing the authorized porting process, US Mobile may require you to enter your current account's password before US Mobile can initiate a port request and obtain a Confirmed Port Date. The Confirmed Port Date will be established pursuant to industry and any applicable regulatory standards; however, since the time required to port number(s) will be affected by the accuracy of information provided to US Mobile by you, as well as the actions of your pre-existing voice provider, US Mobile makes no assurances regarding the time required to port any number(s).
New numbers created as part of our Free Trial are not eligible for porting out until after a plan has been purchased for that line. We also do not allow the activation of lines for the purpose of abusing other carrier's port incentives. This is an abuse of our flexible plan offering to take advantage of our industry peers. Additionally, we will alert the other carriers of these actions such that they may take the appropriate measures.
Mobile phone number
The mobile phone number we provide is for your use while you are a customer. If you cancel your service or your account is deactivated, we may give your mobile phone number to another customer without notice (unless you transfer the mobile phone number to another telecommunications provider in accordance with applicable regulations). While we do not expect to change your mobile phone number, and such changes are rare, under certain circumstances, we may be required to change your mobile phone number; if we do so, however, we will notify you prior to any change.
Promotional and referral codes
From time to time, you may receive a promotional code or referral code provided by or on behalf of US Mobile ("Promo Codes"). The Promo Codes may have limitations and restrictions identified by a promotion. A Promo Code may only be entered once and may not be combined with other promotions or Promo Codes, unless otherwise expressly permitted by US Mobile. We are under no obligation to release, honor, or maintain any Promo Codes or services provided through Promo Code redemption. US Mobile reserves the right to limit, modify, or discontinue services accessed by Promo Codes for any reason even after such service has been redeemed, at our discretion and without prior notice to you. Promo codes may not be distributed on coupon sharing sites or any other channels deemed by US Mobile to circumvent their intended usage.
Price Matching: US Mobile does not offer price matching on any plans, devices, or services, including promotional, limited-time, or discounted offers. All pricing is final and cannot be adjusted to match past or future promotions.
Customer identity
US Mobile customers are prohibited from creating and using false subscriber accounts used to mask real identities or to otherwise interfere with US Mobile's direct line of communication with the actual users of our network and service.
In addition, customers are prohibited from creating multiple subscriber accounts used for circumventing US Mobile's pricing, plans, discounts, or services.
Any subscriber accounts without unique, accurate, and verifiable customer identity information are subject to immediate line suspension without refund or prior notice.
Customer information
When you agree to the Terms of Service, you also agree to the terms of our Privacy Policy available on our website. This policy may change from time to time and includes important information on what data we collect about you, how we use this data and with whom we share that data.
In the course of providing service to you, we may collect certain information made available to us solely because of our relationship with you, including information regarding the nature and type of your service and the calls that you place and receive. We always will handle this data, which is "Customer Proprietary Network Information" ("CPNI"), in accordance with Federal Communications Commission regulations, federal consumer privacy laws and our Privacy Policy. We take reasonable steps to protect CPNI and your other personal information from unauthorized use or disclosure. We will not intentionally share your personal information without your permission.
We are legally and contractually obligated to cooperate with law enforcement in the investigation of violations of law. We may disclose to law enforcement authorities and governmental agencies any information, including your name, account history, account information or other transmission data properly requested by law enforcement.
Dispute resolution
We and you each agree to contact each other first with any disputes. You must contact us with any dispute by the means indicated on our website. Please provide a description of the problem, all relevant documents/information and the proposed resolution. We will contact you at the last address that you have provided us or on your mobile phone. We each agree to negotiate in good faith to resolve any dispute.
If a claim proceeds in court, we each waive any right that we may have to trial by jury in any lawsuit or other proceeding to the extent permitted by law.
Limitation of liability, indemnity
We and you agree to limit claims for damages or other monetary relief against each other to direct and actual damages unless prohibited by law. You agree that we and our business partners are not liable to you or any third party for any indirect, special, incidental, consequential, exemplary or punitive damages of any kind, including lost profits (regardless of whether we have been notified that such loss may occur) by reason of any act or omission in our provision of products or services or under any legal theory, including fraud, misrepresentation, breach of contract, personal injury, product liability or any other theory. We assume no risk or responsibility for your use of any content. We are not liable for (1) any act or omission of any other company furnishing a part of our service or any equipment provided for such service; (2) errors or omissions of our business partners; (3) any damages that result from any product or service provided by or manufactured by third parties; or (4) any unauthorized or disputed charges for our services that appeared more than 30 days earlier on your online account statement which you did not promptly dispute in accordance with the Terms of Service. You acknowledge that no fiduciary or other special relationship exists between you and us, by virtue of the Terms of Service or your use of our Services. You also agree we are not liable for missed voicemails or deletion of contacts from your address book, content, or lost messages from your voicemail system.
You agree to indemnify and hold harmless us and our affiliates and their respective officers, agents, partners and employees, from any and all liabilities, settlements, penalties, claims, causes of action and demands brought by third parties (including any costs, expenses or attorneys' fees on account thereof) resulting from your use of our products and services, or use of our products and services by another person who uses your mobile phone and/or our products or services, whether based in contract or tort (including strict liability) and regardless of the form of action.
Resellers, Dealers, and Intermediaries'
We do not allow resellers, dealers or other intermediaries to use our name and service without written authorization from the US Mobile Compliance Department.
Prohibited reseller activities include, but are not limited to: (a) the use of our name and branding (b) the ordering of SIM cards or phones with intention to resell or give away in connection with a related revenue generating activity (c) any revenue generating activity related to US Mobile products or services, such as reselling our SIM cards or activating US Mobile service for others in exchange for money or services.
Effect of terms of service
These Terms of Service supersede all oral or written communications and understandings between you and us with respect to our products and services and the terms under which they are offered and provided to you. If any part of the Terms of Service is declared invalid or unenforceable, all other parts of the Terms of Service are still valid and enforceable. No provision of the Terms of Service provides any person or entity not a party to the Terms of Service with any remedy, claim, liability, reimbursement, or cause of action, or creates any other third-party beneficiary rights.
Unless otherwise specified herein, any disputes of a legal nature, whether a claim, complaint, arbitration demand or otherwise, shall be subject to the exclusive jurisdiction of the federal or state courts located within the State of Delaware, except in the case of a customer resident in the State of California, in which case such disputes shall be within the exclusive jurisdiction of the federal or state courts of or in the California county in which the customer primarily uses the service.
Applicable charges
The charges payable by you for Services, including, without limitation any amounts due with respect to any applicable Mobile Device(s), are as provided in your service plan and these Terms of Service. Except as expressly provided in these Terms of Service or your service plan, US Mobile may increase any applicable charges upon at least thirty (30) days' prior written notice to you. All rates and charges are subject to change immediately if there is any Regulatory Activity. If any Regulatory Activity occurs, US Mobile reserves the right, at any time with as much advance written notice as commercially reasonable and without liability to US Mobile, to modify Services, charges, rates, promotions, terms and/or conditions of these Terms of Service to conform to such Regulatory Activity; or if such Regulatory Activity materially and adversely impairs the provision of Services, as determined by US Mobile, terminate these Terms of Service.
In addition to the service charges invoiced by US Mobile, the Company also imposes a separate Recovery Fee ("RF") on certain plans. The RF is based on a sliding scale and can vary based on the plan selected. The RF is a discretionary fee collected and retained by US Mobile to help recover and defray certain costs the Company incurs, including:
1) Federal and state regulatory fees associated with Universal Service programs, the provision of telecommunications services for the sight and hearing impaired, local number portability, and North American Numbering Plan administration; and
2) Administrative costs, fees and expenditures related to compliance with federal and state regulatory programs and annual FCC regulatory fee obligations; and
3) State and local transaction tax and 911 fee obligations associated with the provision of telecommunications services.
The RF is not a government tax, or government-imposed fee.
Assignment
You may not assign your rights or delegate any of your duties under the Terms of Service without our prior written consent, and any attempted assignment or delegation without such consent is void. We may assign all or part of the Terms of Service or your debts to us without notice.
These Terms of Service, together with any attachments referenced in these Terms of Service, including, without limitation, the terms of any applicable service plan, the acceptable use policy posted at https://www.usmobile.com/privacy-policy.html, or any other addenda entered into from time to time, each of which is incorporated herein by reference, constitute the entire understanding between you and US Mobile. You are not relying on any affirmation of fact, description, or promise from (or purported to be from) any person or entity, nor any other oral or written representation or warranty that is not expressly included in these Terms of Service.
When you accept these Terms of Service, you are representing that you are at least 18 years old and are legally able to accept an agreement. If you accept on behalf of any organization, you are representing that you are authorized to bind that organization and, where the context requires, "you" means the organization.
SMS Policy
US Mobile provides SMS services to our customers under the following terms to ensure responsible use and compliance with applicable laws and regulations.
1. Consent to Receive Messages:
• By opting into our SMS services, you agree to receive SMS messages from US Mobile at the phone number provided during registration or as updated by you. Messages may include, but are not limited to, operational notifications, service updates, and marketing communications.
2. Opt-Out Procedure:
• You may opt out of receiving SMS messages from US Mobile at any time by texting the word STOP to the designated number provided in our messages. Upon receiving your request, we will send a single confirmation message and cease sending SMS messages to your number.
3. Message Frequency:
• The frequency of SMS messages will vary depending on your interactions with US Mobile and the preferences you set. Typical message frequencies range from daily updates to occasional alerts.
4. Fees and Charges:
• US Mobile does not charge for sending or receiving SMS messages as part of our service offerings. However, message and data rates may apply according to your mobile carrier plan.
5. Content Standards:
• All messages sent by users of the US Mobile network must comply with our Acceptable Use Policy as outlined in the broader terms of service. Prohibited content includes, but is not limited to, unlawful, threatening, abusive, defamatory, or obscene material.
6. Privacy:
• Your privacy is important to us. US Mobile will use the information you provide only in accordance with our Privacy Policy. We will not share or sell your phone number to third-party marketers without your explicit consent.
2G and 3G shutdown
The 3G networks of all major national wireless carriers will be decommissioned in 2022 to free up frequency bands for the faster, more efficient and more reliable 4G and 5G networks. 3G-only phones will no longer be able to place or receive calls or access other data services, such as emergency services.
Our GSM partner's 3G network will begin being shut down on July 1, 2022, and our Warp partner will begin turning off the last of their 3G CDMA network on December 31, 2022. Affected US Mobile customers who still have a 3G device will be informed and we will strongly encourage them to make a change as soon as possible to avoid degradation and loss of service.

Receiving and Using Rewards
US Mobile reserves the right to limit, cancel, delay, or revoke a reward if US Mobile determines, at its sole discretion, that an Eligible Participant has violated these Terms or the US Mobile User Agreement, has acted in a fraudulent or abusive manner, or if US Mobile restricts or closes their Valid Account pursuant to the US Mobile Terms and Conditions.
US Mobile may provide an alternate reward of equal value if it is unable for any reason to fulfill the reward. Reward redemptions are final, will not be returned, and are subject to review and verification.
US Mobile is not responsible or liable if any email, reward, referrals, or Program-related materials or correspondence are lost, stolen, fraudulent, abusive, late, incomplete, illegible, interrupted, delayed, altered, defective, misdirected, tampered with, or irregular in any way, or if any participant’s e-mail address, Valid Account, or other contact information does not work, is deleted, or is changed without prior written notice to US Mobile.
The Program is void where prohibited, or if an Eligible Participant’s accounts or transactions are fraudulent, abusive, not completed through legitimate channels, in violation of these Terms, or irregular in any way.
Multi-Month Plans
All US Mobile billing cycles are measured on 30-day monthly cycles regardless of calendar month length. Any products, plans, deals, or references to multi-month plans are measured and sold with the same 30-day monthly cycles including but not limited to service duration, talk, text and data allotments. A "twelve month", "annual", or "yearly" plan will be equivalent to twelve 30-day monthly cycles. In addition, while US Mobile will not charge for months of service already paid for with a multi-month plan, lines are required to keep Autopay on with a valid credit card on file in order to be provisioned for each subsequent month of service. Porting out from US Mobile immediately forfeits any remaining days or billing cycles on a multi-month plan.
Multi-Month plans may not be available for renewal after completion of the current multi-month plan. US Mobile will either default your Autopay to the same plan in multi-month or single month format or a reasonably similar plan is available at the time of renewal. Autopay orders are charged two days before the start of the next cycle to ensure continuity of service in the event of a failed charge attempt.
US Mobile is not liable for changes in network coverage throughout the term of multi-month plan.
Additional Multi-Month Terms
Each customer account is eligible for a maximum of five multi-month lines, unless explicit written approval is obtained from US Mobile. The account must maintain a valid credit card on file for each line for the entire duration of the multi-month plan period.
For new lines, the multi-month plan period begins from the day the line is activated on the offer plan. The plan will be available for activation in the user dashboard for up to 90 days after the date of purchase. For existing lines, the 12-month plan period begins from the start of the next billing cycle after plan selection.
For any prepaid card offer on a "twelve month", "annual", or "yearly" plan, customers are eligible to receive the prepaid card after 6 months of continuous service on the "twelve month", "annual", or "yearly" plan associated with the offer. There is a limit of 5 lines per customer account that are eligible for a prepaid card offer on a "twelve month", "annual", or "yearly" plan.
This offer may not be available or combined with other offers or promotions. Pricing, promotions and terms & conditions subject to change without prior notice. The offer is applicable for phone lines only and is not redeemable or exchangeable for cash or credit towards any other purchase, unless explicitly stated. Taxes and fees may be included in the plan or charged separately. This offer is subject to limited supply during the promotional period, and additional restrictions may apply.
Refund Policy
Activation and Refund Policy
The plan period for new lines begins from the day of activation. The plan will be available for activation in the user dashboard for up to 90 days after the date of purchase.
Refund policy for month-to-month plans:
Customers can request a refund for the current cycle of a specific plan only if all the following conditions are met:
• It has been less than 45 days since the plan was purchased
• It has been less than 30 days since the plan start date
• There has been no usage within the current cycle
• The plan is not a snooze plan
• For lines on an unlimited plan that includes roaming, there has been zero usage of any roaming data, talk, or text
If there has been usage within the current cycle, so the third condition above is not met, but all other conditions are still met, customers can request a partial refund that will be calculated as following:
• For a non-unlimited plan, customers can receive prorated refunds based on the amount of data used in the current cycle
• For unlimited plans, customers can receive a refund of the amount paid for the current cycle minus $2 per GB for each GB of Premium data used according to US Mobile's internal metering.
The following purchases are not refundable:
• Snooze plans, Top Ups, SIM card purchases, Starter Kits, and any services rendered in a prior or completed billing cycle are not eligible for refunds.
Refund policy for multi-month plans:
• Customers can request a refund for a multi-month plan if all the following conditions are met:
• It has been less than 45 days since the plan was purchased
• For new lines, it has been less than 7 days since a new line was activated; for existing lines, it has been less than 7 days since the multi-month plan billing cycle started for the line
• Less than 1 GB of data has been consumed on the plan
• For lines on an unlimited plan that includes roaming, there has been zero usage of any roaming data, talk, or text
If the above conditions are not all met, the plan is non-refundable.
No refunds will be provided if you choose to change your plan part-way through any multi-month plan.
• By changing plans, you may permanently lose access to the multi-month plan if it was a temporary offer (e.g. a one-off Cyber Monday promotional offering).
• You may receive monthly service credit for any unused months of your multi-month plan towards your new plan by contacting the US Mobile customer support team. Unused months will be calculated as future remaining monthly cycles on the multi-month plan. The maximum monthly service credit will be calculated as: the total cost of the multi-month plan divided by the duration of the multi-month plan.
• The amount of monthly service credit received will be either the total monthly cost of your new plan or the maximum monthly service credit as calculated above, whichever is smaller.
• Monthly credits will only be received for the number of months equal to the unused period of the multi-month plan.
• Cancellation or porting out from US Mobile immediately forfeits any remaining days or billing cycles on a multi-month plan.
Refund policy for international roaming top-ups:
A customer can request a refund for an international roaming add-on or top-up that is purchased in addition to the regular service plan on a line if there has been zero usage of any roaming data, talk, or text. Any roaming usage will render the add-on or top-up non-refundable.
Refund policy for data only international eSIMs (purchased either via the US Mobile app or the Global by US Mobile app):
Purchases of international data only eSIMs may be fully or partially refunds in the event of a service malfunction. If your service does not work or stops working due to product malfunction, network outage, or other technical faults in the product or service, we may issue a full or partial refund, pending an investigation by our customer support team.
However, we are unable to offer refunds for the following cases, regardless of whether the product or service has been used:
• Ineligible device: Please note that your device must be eSIM-compatible in order to use a Global by US Mobile plan. We are unable to provide refunds for plans purchased on ineligible devices.
• Incorrect setup: Please be careful to follow the setup instructions very carefully, as we cannot issue a refund if you are unable to access your plan due to user error.
• Customer-induced damage: If you accidentally delete your eSIM, we are unable to issue a new one or provide you with a refund.
• Wrong purchase: Be careful to purchase the exact plan you intend on using, as we are unable to exchange plans or offer a refund if you purchase the wrong plan.
• Change on mind: If you no longer want or need your Global by US Mobile plan after making a purchase, we are unfortunately not able to refund you.
• Failure to inform: If you believe you are eligible for a refund, please contact customer support for troubleshooting immediately. If you do not notify us in a timely manner, we will be unable to issue a refund.
In order to determine whether or not you are eligible for a full or partial refund, please contact customer support for troubleshooting.
Refund Policy for Multi-Network Line Adjustments
Eligibility for Refund: Existing lines on a full service plan that are transferred from their existing plan to a multi-network add-on plan (that is, this line is used as the add-on line) may be eligible for a refund if the following conditions are met:
1. The line must have been moved to a multi-network add-on plan during the early access period prior to the public release of the multi-network add-on on February 24, 2025.
2. The line that is being moved to a multi-network add-on plan is on an annual plan and the primary line to which it is attached as a multi-network add-on is on an Annual Unlimited Premium plan.
3. The line must be used on the same device as the primary line; if the line is currently on a different device, it must first be moved to the device with the primary line before it can be converted to a multi-network add-on and before a refund can be issued.
Refund amount calculation: The amount refunded will be calculated as follows:
1. We will count the number of completely unused/future 30-day cycles (the current cycle will not be refunded, even if part way through)
2. Multiply the number in (1) by the monthly equivalent price paid for the annual plan. E.g. if the line was on an annual Premium plan that cost $390/year, or $32.50/month equivalent, and had 4 future monthly cycles remaining, the refund amount due will be $32.50 * 4 = $130.
3. No additional refunds will be granted if the customer discontinues the multi-network line or opts for another configuration.

Device Protection
1. Provider and Governing Terms
U.S. Mobile is a reseller of optional Device Protection plans administered by AKKO LLC (AKKO). Device Protection plans are optional. Should you choose to add Device Protection, you agree to all terms and conditions, including AKKO’s Terms of Use, privacy policy, and disclosures found here.
2. Covered Losses
Insurance: Loss and theft
Service Contract: Accidental damage or breakdown (incl. electrical or mechanical failure)
3. Covered Equipment
Device Protection plans are available for phones (includes wireless device and battery). Coverage applies to only one line at any given time and the covered device will be the device that, at the time of loss, has been activated, enrolled and verified (or re-verified) in accordance with the provisions of Sections 4 and 10 below You must own or lease the device and must use the device (logged voice or data use) on your enrolled wireless line after initial enrollment. Exclusions: tablets, wearables, laptops, or other IoT devices.
4. Plan Activation
Device Protection plans are not active until all enrollment steps are completed, including activating the associated U.S. Mobile line and completing the AKKO enrollment process, which includes providing device information and verifying device condition where required.
Coverage for damage, loss, and theft becomes effective immediately once all enrollment steps are completed. Mechanical and electrical breakdown coverage becomes effective 30 days after the Device Protection plan activation date.
5. Pricing and Taxes
Pricing and promotions for Device Protection plans are subject to change at U.S. Mobile’s discretion. Plan prices exclude sales tax. Sales tax will be calculated separately and applied to the taxable service contract portion of the plan price. The total tax amount varies by location.
6. Payment and Autopay
Enrollment in this Plan will continue to renew monthly (or every 12 months, if you purchased the annual Plan) on your U.S. Mobile account until cancelled. If Autopay is enabled, U.S. Mobile will attempt to collect payment up to 2 days before the due date, on the due date, and up to 2 days after the due date.
If payment is not successfully processed by the due date, your Device Protection plan will enter “Past Due” status, during which time new claims cannot be filed. You may restore your plan to active status by making payment within 30 days. If payment is not made within 30 days after the due date, the Device Protection plan will be canceled.
7. Cancellation
Cancellation may be requested at any time by contacting U.S. Mobile support. U.S. Mobile and AKKO reserve the right to cancel plans for suspected abuse, fraud, material misrepresentation, or other violations of these Terms. Any refund due upon cancellation will be processed according to the refund policy below.
8. Refund Policy
U.S. Mobile will issue a full refund if you cancel within 30 days of activation. After 30 days, the following refund policy applies:
Annual Plan: refunds will be calculated on a pro-rated basis in accordance with the 365-day plan duration.
Monthly Plan: no refunds will be issued; however, no further charges will be incurred. Claims may continue to be submitted through AKKO until the conclusion of the current plan cycle.
9. Communications
By purchasing a Device Protection plan, users consent to receive all communications electronically, including via email and text message. No paper mail will be sent.
10. Device Changes
It is Your responsibility to ensure that U.S. Mobile and Akko always have the most up-to-date device information.If you change devices, You must complete the enrollment and verification steps in Section 4 to ensure your new device is associated with your active line under the Plan. While U.S. Mobile will attempt to update your profile when we receive notification from the carrier about a device change, carrier information may be delayed or updates may not process successfully. Further, profile updates are not a substitute for completing the enrollment steps in Section 4. Claims can only be filed if the new device is associated with the line that is active on the plan, after following the enrollment and verification procedures in Section 4 U.S. Mobile is not responsible for damage, theft or loss for devices not enrolled and verified in accordance with Section 4.
11. Modifications
U.S. Mobile and AKKO reserve the right to modify these Device Protection terms at any time. Material changes will be communicated in accordance with applicable law.
Data Collection & Usage

To provide and maintain our services, US Mobile collects the following types of personal information:
• Identifiers, such as your name, email address, phone number, and billing/shipping address.
• Account Records, including service plan details and payment history.
• Usage Data, encompassing text, call, and data logs.
• Website and App Interaction Data, related to your activity on our platforms.
• General Location Data when using our mobile or web applications.
2. Specific Pieces of Personal Information We Have
We retain specific details associated with your account, including contact information, service plan details, payment records, and usage logs. Should you wish to obtain a comprehensive report of the data we hold, please reach out, and we will provide this within the CCPA-mandated timeline.
3. Sources of Personal Information Collection
US Mobile collects personal information from:
• Direct Interactions, such as account registration and customer support communications.
• Automated Technologies, during your use of our services or interactions with our platforms.
• Payment Providers, when processing transactions on our platforms.
4. Purpose of Data Usage
We utilize personal information for the following purposes:
• To deliver, enhance, and support our services.
• To manage billing, payments, and provide customer support.
• To maintain security and prevent fraudulent activities.
• For marketing and promotional activities related to our services.
5. Sharing of Personal Information
We may share your personal information with trusted third-party service providers, including:
• Payment Processors, solely for transaction processing.
• Secure Cloud Storage Providers for safe data management.
• Legal and Regulatory Authorities, as mandated by applicable laws.
6. Sale of Personal Information
US Mobile does not sell your personal information under any circumstances.

Appendix A - ILD CONSUMER AGREEMENT
Introduction
This ILD Consumer Agreement ("Agreement") sets forth the terms and conditions that apply to Your purchase of Services from NetworkIP, Inc dba Elite Telecom through US Mobile, Inc. By using the Services, You agree to the terms and conditions in this Agreement and any changes that may be made to the Agreement. If You do not agree to the terms of this Agreement or have any questions about the Agreement, do not purchase or use our products without contacting Customer Service at (878) 205-0088.
Definitions
"Account" refers to usage within a billing cycle for a predetermined set of international destinations purchased through US Mobile, Inc and/or a prepaid balance established with US Mobile, Inc which are associated with the Consumer's phone number allowing Consumer to purchase and use the Service.
"Elite Telecom," "We," "Our," and "Us" means NetworkIP, Inc (d.b.a. Elite Telecom)
"Service" means the International Long Distance (ILD) Service provided by Elite Telecom which provides the Consumer with international calling capability.
"Consumer", "You" and "Your" means the end-user of the Service and also the owner of the Account.
"Website" is the website found at or such other location as designated by US Mobile, Inc and contains the specific prices and charges, Service descriptions and other terms and conditions not set forth here that apply to the specific Service.

This Agreement incorporates by reference the Service's prices, charges, restrictions and the terms and conditions for using the Service and/or owning an Account, as well as any disclosures, provisions, limitations or other information provided with, or printed on any promotional materials associated with the Service.
Charges and Payment
Price, Feature and Rate Changes
We may change the prices or features associated with the Service from time to time, and such changes will be effective from the time they are posted or available through the Website. The terms and conditions of the Service, including the rates for calls made and/or available destinations in conjunction with the use of the Service are subject to change at any time without prior notice. All calls for the PAYGo ILD Service are billed in one minute increments. The PAYGo ILD Service expires 180 days after last use or 30 days after account suspension. There are no additional fees or surcharges associated with the Services. The Unlimited ILD Service is provided solely for live dialogue between, and initiated by, two individuals for personal use and not for commercial use or resale. UNLIMITED DOES NOT MEAN UNREASONABLE USE. In addition, certain destinations may be limited to an advertised maximum number of minutes. To minimize unreasonable use, each Unlimited Account will be allowed to call up to 15 unique destination numbers per Unlimited cycle which expire 30 days after initial funding or last renewal. The number of personal use calls to these unique destination numbers is not limited and automatically resets when the Account is renewed. You may contact Customer Service at (878) 205-0088 or visit the Website if You have any questions about the Service, including the international long distance rates or available destinations associated with the Service.
Suspending/Canceling the Service
If We have reason to believe that You or someone else is abusing the Service fraudulently or unlawfully through Your Account, or if Your form of payment for the Service is cancelled, disabled, discontinued or otherwise dishonored, We reserve the right to immediately suspend, restrict, deactivate or cancel the Service and close Your Account without advance notice. In the event of suspension or cancellation of the Service due to any other aforementioned reasons, Elite Telecom may from time to time discontinue offering the Service, or if necessary, cancel all Accounts, immediately upon a determination by any governmental authority that the provision of the Service is contrary to any law, rule or regulation or upon Your violation of this Consumer Agreement.
The Unlimited ILD Service may be used for personal telecommunications voice services and may not be used for any other purposes, including, but not limited to, loaning or renting Your handset to third parties, conference calling, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing, autodialed calls, other commercial uses, or other connections that do not consist of uninterrupted live dialogue between two individuals. If usage, dialing or calling patterns We deem connote non-personal use, We reserve the right to suspend, terminate or restrict Your Services with no prior notice and not allow You to reactivate the Service.
Elite Telecom and US Mobile, Inc are not responsible for any ancillary costs incurred by You, including but not limited to, cell phone provider charges or fees and/or penalties incurred by You in the event You use the Service for any unlawful purpose.
Restrictions on Use; Intellectual Property
All of Elite Telecom and US Mobile, Inc trademarks, service marks, symbols, logos, other identifying indicia and the intellectual property rights thereto (collectively "Marks") are the property of Elite Telecom or US Mobile, Inc and You shall have no right in or to the Marks or any right to use the Marks including any and all Marks associated with the Service and the Website. You are not permitted to commercially resell the Service or to print, produce, sell or distribute anything containing the Marks or to sell or distribute any telecommunication products that use or are associated with the Service.
Indemnification
You agree that neither Elite Telecom nor US Mobile, Inc's shall be responsible for any third party claims against Elite Telecom, US Mobile, Inc and/or You that arise from Your use of the Service or Your Account. Further, You agree to reimburse Elite Telecom and or US Mobile, Inc for all costs and expenses related to the defense of any such claims, including attorneys' fees, unless such claims are based upon Our willful misconduct or gross negligence. This provision will continue to remain in force after the Agreement expires or is otherwise terminated.
Limitations of Liability
This section describes Elite Telecom's or US Mobile, Inc's responsibility for any claims for damages You may assert arising out of the failure of the Service or any other claims You may assert in connection with the Service, or in connection with the transfer of funds to Your Account or with this Agreement. We are not liable for any Service failures. Except as otherwise expressly provided herein, We and Our affiliates, authorized distributors, US Mobile, Inc, partners, directors, officers, members and employees are not liable to You or to any third party for any costs, liabilities or damages arising either directly or indirectly from any cause, action or claim relating to the Service, the Website and/or the telecommunication services underlying the Service, including without limitation any actual, incidental, consequential, exemplary, punitive, reliance or special damages, or for any claims for loss of revenue, lost profits, lost use, data, or goodwill or for lost business opportunities of any kind or nature whatsoever. These limitations apply even if the damages were foreseeable or We were told that they were possible, and these limitations apply whether the claim is based upon contract, tort, statute, fraud, misrepresentation, or any other legal or equitable theory. We will not be liable for any damages if the telecommunication services underlying the Service are interrupted, or if there is a problem with the interconnection of the Service with the service, products or equipment of some other party. This section will survive the expiration or termination of the Agreement. Because some jurisdictions do not permit the exclusions or limitation of incidental or consequential damages, Elite Telecom's liability in such jurisdictions shall be limited to the extent permitted by law.
Warranties
You acknowledge that (a) the Service is provided by Elite Telecom "AS IS", and (b) we make no warranty to You or to any third party whatsoever, directly or indirectly, express, implied or statutory, as to the suitability, durability, description, quality, title, non-infringement, merchantability, completeness or fitness for use or purpose of the Service or any Elite Telecom product associated with the Service. All such warranties are hereby expressly excluded and disclaimed. We also make no warranty that the Service will be uninterrupted or error free. We do not authorize anyone, including, but not limited to, Elite Telecom employees or US Mobile, Inc, to make any warranties on Our behalf and You should not rely on any such statement. Your use of the Service is solely at Your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to You.
Miscellaneous
Emergency Calls
Elite Telecom's applications and services are not a replacement for Your cellular service and You will not be able to make emergency calls (e.g. 911) using them. Our services do not prevent You from using Your phone to make emergency calls, however cellular service may not be available everywhere. If You are in a location without cellular service You will need to make other arrangements. Emergency calls are NOT supported outside the domestic USA.
No Third Party Rights
This Agreement does not provide any third party with a remedy, claim, or right of reimbursement.
Acts Beyond Our Control
Neither You or Elite Telecom or US Mobile, Inc will be responsible or liable to the other for any failure to perform duties under this Consumer Agreement where that failure is due to an act outside the reasonable control of You, Elite Telecom, or US Mobile, Inc (Force Majeure Event), including but not limited to the failure to perform due to any of the following: fire, explosion, power blackout, earthquake, volcanic action, flood, the weather elements, strike, embargo, civil or military authority, war, acts of God, acts or omissions of carriers or suppliers, or acts of regulatory or governmental agencies.
Assignment
We can assign all or part of Our rights or duties under this Agreement without notifying You. If We elect to make such an assignment, We will have no further obligations to You under this Agreement or in connection with Your purchase or use of the Products. You may not assign this Agreement without Our prior written consent.

Any notice from Elite Telecom to You under this Agreement will be provided by one or more of the following: on Our Website, a recorded announcement on a Product, letter, or a call to a telephone number provided by You.

Separability
If any part of this Agreement is found invalid, the rest of the Agreement will remain valid and enforceable.
Governing Law
This Agreement will be governed by the laws of the District of Columbia, without regard to its choice of law rules. This governing law provision applies no matter where You reside, or where You use, purchase or pay for the Products.
Entire Agreement
This Agreement constitutes the entire agreement between You and Elite Telecom and supersedes all prior agreements, understandings, statements or proposals, and representations, whether written or oral. This Agreement can be amended only as provided in the Changes to the Agreement section below. No written or oral statement, advertisement, or service or product description not expressly contained in the Agreement or the Website will be allowed to contradict, explain, or supplement this Agreement or the Service. Neither You or Elite Telecom is relying on any representations or statements by the other party or any other person that is not included in this Agreement.
Changes to the Agreement
This Agreement may only be changed in the manner provided for in this section. Elite Telecom through US Mobile, Inc may change this Agreement and the information contained elsewhere on the Website from time to time.
